Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Matro app ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Kolibri Nest AS ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use Matro. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

Matro is not designed for use by children under 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it promptly.

3. Description of Service

Matro is a food logging and nutrition tracking application that uses artificial intelligence to help users estimate calorie and macronutrient content of meals. Features include:

• Manual food logging
• AI-assisted meal analysis via photo and text description
• Barcode scanning
• Personalized calorie and macronutrient goal calculations
• Weight tracking and progress monitoring

Some features require a paid subscription ("Matro Pro"). Free features remain available without a subscription.

4. Not Medical Advice

All calorie calculations, macronutrient recommendations, and nutritional estimates provided by Matro are for general informational and wellness purposes only. They are based on established formulas and AI estimation, and are not a substitute for professional medical, nutritional, or dietary advice.

You should always consult a qualified healthcare provider before making significant changes to your diet, especially if you:

• Have or suspect any medical condition
• Are pregnant or breastfeeding
• Are taking medication
• Have a history of eating disorders

Kolibri Nest AS is not liable for any health outcomes resulting from use of information provided by the App.

5. AI-Generated Content and Accuracy

Matro uses artificial intelligence to analyze food photos, text descriptions, and product information. AI-generated nutritional estimates are approximations only.

You acknowledge that:

• AI estimates may be inaccurate and should not be relied upon for medical or clinical purposes
• Nutritional content of foods varies by preparation method, brand, portion size, and other factors
• We do not guarantee the accuracy of any nutritional data provided by the App

We are continuously working to improve the accuracy of our AI analysis, but we cannot warrant that estimates are error-free.

6. User Accounts

To use Matro, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscriptions and Payments

Matro Pro is available as a paid subscription with a 7-day free trial.

Depending on your platform:

The following terms apply to all platforms:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• No refunds are provided for partial subscription periods, except where required by applicable law
• Free trial: If you do not cancel before the 7-day trial ends, you will be charged the subscription price

8. Account Deletion and Data

You may delete your account at any time from within the App (Settings → Account → Delete account). Upon deletion:

• Your personal data, food logs, and weight history will be permanently deleted
• Your account cannot be recovered after deletion
• Subscription access will remain active until the end of the current billing period

9. Third-Party Services

Matro integrates with third-party services to provide certain features, including authentication, payments, AI analysis, and food data. By using the App, you acknowledge that some of your data may be processed by these third parties in accordance with their own privacy policies. We select our service providers carefully and require that they maintain appropriate data protection standards.

We are not responsible for the practices of third-party providers.

10. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated scripts or bots to access the App or our APIs
• Intentionally submit false or misleading food data
• Attempt to circumvent subscription requirements or in-app purchase systems
• Share your account credentials with others

11. Intellectual Property

All content, design, trademarks, and technology in the Matro App are owned by Kolibri Nest AS or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of any personal data you enter into the App (food logs, weight entries, etc.).

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• Nutritional information will be accurate or complete
• The App will meet your specific requirements

13. Limitation of Liability

To the maximum extent permitted by applicable law, Kolibri Nest AS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health outcomes, data loss, or lost profits.

Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Governing Law

These Terms are governed by the laws of Norway. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

For users in the United States: To the extent permitted by law, you waive any right to a jury trial and agree that any dispute will be resolved on an individual basis (no class actions).

16. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete your personal information, and the right to opt out of the sale of your personal information.
